samenvatting: A lesbian couple in Ohio wanted to change their names in order to create a common family name for themselves and their daughter; the judges who first heard the case objected that this was "against natural law"; the women then spent over two years in various legal proceedings, including a hearing in front of the state Supreme Court before judges granted the name change.

Do lesbians change their last names in the context of a committed relationship?  / Elizabeth A. Suter, Ramona Faith Oswald.

Journal of Lesbian Studies, 7 (2003) 2, p. 71-83
bron: Journal of Lesbian Studies jaargang: 7 (2003) 2 , p. 71-83
samenvatting: This exploratory study begins to redress a critical gap in the literature on committed same-sex relationships and last name practices. Data were gathered from an Internet survey, which included 16 lesbian respondents currently in a same-sex relationship. Analyses explored individual, couple, and family of origin factors associated with changing or not changing one_s name. Name-changing was cited as a strategy for securing external recognition and acceptance of family status by outsiders. Not changing was cited as a strategy to preserve each partner_s individual identity. Contrary to our expectations, changing one_s last name was not associated with having a commitment ceremony. Instead, name-changing was ritualized on other occasions, special to the individual couple, such as an anniversary, a partner_s birthday, or an intimate dinner party among friends. Draft Law on the Changing of Forenames and the Determination of Gender Identity  / [transl. from the German] ; tabled by the members of the German Bundestag Volker Beck, ... and the Alliance 90/The Greens parliamentary group.

samenvatting: The Act on the Changing of Forenames and the Determination of Gender Identity in Special Cases, or Transsexuals Act (Gesetz über die Änderung der Vornamen und die Feststellung der Geschlechtszugehörigkeit in besonderen Fällen - Transsexuellengesetz (TSG)) is almost 30 years old and no longer accords with current scientific knowledge. It creates unjustified obstacles to the changing of forenames and the determination of gender identity which violate the dignity and self-determination of transsexual persons. The Federal Constitutional Court has already ruled on five separate occasions that individual provisions of the Act are unconstitutional. Other provisions of the Act are also subject to criticism under constitutional law. The TSG is replaced with the Act on the Changing of Forenames and the Determination of Gender Identity (Gesetz über die Änderung der Vornamen und die Feststellung der Geschlechtszugehörigkeit - ÄVFGG) The procedure is simplified and will be carried out by the registry offices.

The Afterlife of Data : Identity, Surveillance, and Capitalism in Trans Credit Reporting  / Lars Z. Mackenzie.

TSQ: Transgender Studies Quarterly, 4 (2017) 1 (feb), p. 45-60
bron: TSQ: Transgender Studies Quarterly jaargang: 4 (2017) 1 (feb), p. 45-60
samenvatting: Credit reports, once solely used to determine individual creditworthiness, have in the past several decades become a tool for authentication processes not directly related to one's capacity to take on debt, namely, in rental housing and employment applications. When trans people change their first names to better align with their gender identities, they often become illegible to credit reporting systems. In this article, the author examines online discussion board posts about trans people's experiences with their credit reports, arguing that the issues trans people encounter illuminate the complex logics of neoliberal capitalism, predatory lending, and the 'afterlife' of identification data enabled by big data surveillance.

Legal Gender Recognition : A Multi-Country Legal and Policy Review in Asia  / Jensen Byrne, Cianán Russell ; ed. Andy Quan.

Bangkok: UNDP ; [etc], 2017 - viii, 86 p.
uitgave: Bangkok : UNDP ; [etc], 2017 - viii, 86 p.
onderwerpen:
thema:

  2. transgender
samenvatting: As this report demonstrates, transgender people's dignity, equality, privacy and security are severely compromised if their gender identity and expression is not recognized through legal and administrative processes. This report is based on a comprehensive review of existing laws, policies and practice conducted over 18 months in 9 countries in Asia. Additionally, over 220 transgender people from more than 80 civil society groups added their voice and lived realities to the study's findings. This report is premised on the belief that detailed assessments of relevant laws, regulations, court decisions and policies, including the context within which they have developed, provide a robust basis for strategic planning on how to overcome the barriers that transgender people face. This report shows that the vast majority of transgender people in the region do not have access to legal gender recognition, either because no such provisions exist in their country or due to practical limitations in how court judgments or parliamentary decisions have been implemented.

samenvatting: UNDP, as part of the Being LGBTI in Asia initiative, is conducting a multi-country project looking at legal gender recognition for transgender people in nine countries in Asia Pacific. Each country's review will be conducted by a national consultant, using this assessment tool. The tool provides a systematic way to consider whether and to what extent current laws, policies, regulations and practices enable access to gender recognition in a way that meets human rights standards. The tool is comprised of three sections: Part I : a description of the assesment process Part II : the assesment guide Part III : annexes containing a section on consideration for intersex people and a glossary of terms.

Trans Legal Mapping Report : Recognition before the law  / Zhan Chiam, Sandra Duffy, Matilda González Gil.

[Brussels]: ILGA, 2017 - [4], 115 p.
uitgave: [Brussels] : ILGA, 2017 - [4], 115 p.
onderwerpen:
thema:
  1. rechtspositie
  2. transgender
samenvatting: This report draws attention to how laws in different countries recognise the rights of trans people to change their identity markers on official documents. Additional features in this second edition include an international law section and collated interviews from activists which speak to the varying situations of trans rights around the world. This report distinguishes between "sex/gender marker change" and "name change" processes, laws and policies. Although the authors recognise that trans and gender-diverse people often do seek name change as part of their social transition or self-affirmation process, the distinction is made because the processes are often entirely separate, sometimes involving different pieces of legislation or policies. It is in the interests of precision that this distinction is in place throughout the report.
